Welcome to kumarunning.com. Kuma is owned by Kuma LLC, based in Puerto Rico ("Kuma"). Kuma provides website features, products, and services to you when you visit or shop at kumarunning.com, or use our products, services, or social media platforms (collectively "Kuma Platform").

Please read these Terms of Use ("Terms") carefully before using the Kuma Platform. These Terms constitute a legally binding agreement between you and Kuma and its affiliates ("We," "us," or "the Company") regarding your use of the Kuma Platform. If you do not agree to be bound by these Terms, please exit the Kuma Platform and refrain from further use.

 1. Privacy

 2. Eligibility
If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian read and accept these Terms on your behalf. By using the Kuma Platform, you represent that (i) you have read, understand, and agree to be bound by these Terms; (ii) you are of legal age to form a binding contract with Kuma; and (iii) you have the authority to enter into these Terms.

 3. Kuma Content
The entire content published on the Kuma Platform, including but not limited to text, graphics, layout, data files, images, sounds, and code ("Kuma Content"), is protected by intellectual property laws. Kuma Content remains vested in Kuma and/or its respective owners. Permission is granted to electronically copy and print hard copy portions of the Kuma Platform solely for placing an order. Any other use, including reproduction, modification, distribution, display, or transmission of any Kuma Content, is prohibited without prior written consent.

Kuma reserves the right to withdraw or alter any Kuma Content from the Platform at any time without notice and shall not be liable for any consequences resulting from such actions.

 4. User Content
Certain parts of the Kuma Platform may allow you to post photos, comments, reviews, or other content ("User Content"). You represent and warrant that you own or control all rights to your User Content. Kuma assumes no responsibility or liability for User Content posted on the Platform.

By posting User Content, you grant Kuma a non-exclusive, perpetual, royalty-free, worldwide license to use, reproduce, adapt, distribute, and display this content in connection with the Kuma Platform and related business purposes. Kuma reserves the right to remove any User Content at any time.

 5. Third-Party Sites
The Kuma Platform may contain links to third-party websites ("Linked Sites"). Kuma has no control over Linked Sites and is not responsible for their content, services, or policies. The use of any Linked Site is governed by that site’s terms, not by these Terms. We are not liable for any issues or losses arising from your use of any Linked Site.

 6. Products
While we strive to ensure product availability and accurate representations on the Kuma Platform, availability is not guaranteed. In case of unavailability, you will be notified as soon as possible. Colors of products may vary depending on your device’s display. Prices on the Kuma Platform do not include potential customs charges or import taxes.

 7. Order
To place an order, you will be required to provide accurate personal and payment information. By providing this information, you represent that it is valid and correct. We may use the information provided to conduct anti-fraud checks. Kuma reserves the right to reject or cancel any order at any time due to issues with payment authorization, availability, or other reasons, without liability.

 8. Termination and Suspension
Kuma may, at its discretion, terminate, suspend, or limit your access to the Kuma Platform for any reason, including violation of these Terms. Following termination, these Terms shall remain in effect for obligations arising before termination. Kuma reserves the right to pursue legal actions, including arbitration, for breaches of these Terms.

 9. Disclaimer of Warranties
The Kuma Platform and its content are provided "AS-IS." Kuma makes no representations or warranties of any kind, express or implied, regarding the Platform, its content, or the services provided. Kuma does not guarantee uninterrupted access to the Platform and disclaims liability for any damages arising from your use of the Platform.

 10. Indemnification and Limitation of Liability
You agree to indemnify and hold Kuma harmless from any claims or liabilities arising from your use of the Platform or breach of these Terms. To the maximum extent permitted by law, Kuma’s liability shall not exceed $500.00 in connection with any claim related to your use of the Platform.

 11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Puerto Rico. Any dispute shall be resolved through binding arbitration in Puerto Rico, according to the rules of the State.

 12. Modification of Terms
We reserve the right to change or modify these Terms at any time. Changes will be posted on the Kuma Platform and will be effective upon posting.

 13. Updating and Reviewing Your Information
You may update your information by logging into your account on the Kuma Platform and modifying your details as needed.

 14. Unsubscribing from Communications
If you wish to stop receiving updates from us, you may use the unsubscribe link included in our communications or update your preferences in your account settings.
